Named Memories respects your privacy. This Privacy Policy explains what information we collect through NamedMemories.com and related communications, how we use and disclose it, how we handle photographs submitted for portraits, and the choices available to you.

1 Information We Collect

We may collect the following categories of information:

  • Contact information, including your name, email address, telephone number, billing details, and any information you provide when contacting us.
  • Order and membership information, including the portrait title or wording you request, products purchased, subscription status, transaction history, and customer-service communications.
  • Customer content, including photographs you submit, instructions, names, dates, captions, and feedback about a portrait.
  • Payment information processed by third-party payment providers. Named Memories generally does not receive or store your complete payment-card number.
  • Device and usage information, such as IP address, browser type, device type, referring pages, pages viewed, approximate location derived from IP address, and interactions with the website.
  • Cookie and analytics information described in the Cookie Policy below.

2 How We Collect Information

We collect information directly from you when you place an order, enroll in or cancel a membership, email a photograph, request support, respond to a proof, or otherwise communicate with us. We also receive limited technical and transaction information automatically from Kajabi and other service providers that support our website, analytics, email, checkout, payment, and security functions.

3 How We Use Information

  • Create, personalize, revise, deliver, and support your Named Memory portrait.
  • Process purchases, administer memberships, provide receipts, and maintain transaction records.
  • Communicate with you about proofs, approvals, fulfillment, customer service, policy changes, and account matters.
  • Operate, secure, troubleshoot, measure, and improve the website and customer experience.
  • Prevent fraud, enforce our policies, comply with law, and protect our customers, business, and service providers.
  • Send marketing communications when permitted. You may unsubscribe from marketing emails using the link in the message, although we may still send transactional communications.

4 Photographs and Portrait Files

We use a submitted photograph and the instructions accompanying it only to create and deliver the requested portrait, communicate with you about the order, address quality or support issues, and comply with legal obligations. After the finished portrait is delivered, we delete the submitted source photograph and working production files from our active systems. Limited residual copies may remain temporarily in routine backups or with service providers until their ordinary deletion cycles are completed. We retain transaction records that do not require retaining the photograph.

We will not publish a customer's source photograph or finished portrait in our gallery, advertising, social media, or other promotional materials without the customer's express permission. Permission may be withdrawn for future use by contacting us, but withdrawal will not affect materials already printed or distributed before we received the request.

5 How We Disclose Information

We may disclose information to service providers that perform services for us, such as Kajabi, website hosting, email delivery, payment processing, analytics, security, printing, mailing, and professional support. These providers may use information only as permitted by their agreements and applicable law. We may also disclose information when reasonably necessary to comply with law, protect rights or safety, investigate fraud or misuse, or complete a merger, financing, acquisition, reorganization, or sale of business assets.

Named Memories does not sell personal information for money. If we begin using personal information for targeted or cross-context behavioral advertising in a way that creates an opt-out right under applicable law, we will update this policy and provide the required privacy choices.

6 Cookies and Analytics

Our website is hosted on Kajabi and uses cookies and similar technologies for essential operation, security, preferences, and analytics. Additional information, including the available controls, appears in our Cookie Policy.

7 Data Retention and Security

We retain personal information only for as long as reasonably necessary for the purposes described in this policy, including customer service, accounting, tax, fraud prevention, dispute resolution, and legal compliance. No method of transmission or storage is completely secure, but we use reasonable administrative, technical, and organizational measures appropriate to the nature of the information.

8 Your Privacy Choices

Depending on where you live and subject to applicable exceptions, you may have the right to request access to, correction of, or deletion of personal information; receive information about our practices; or opt out of certain uses. You may also manage nonessential cookies through the site's cookie-preference controls and unsubscribe from marketing emails.

9 Do Not Track and Global Privacy Control

10 Children

NamedMemories.com is not directed to children under 13, and we do not knowingly collect personal information directly from children under 13. An adult submitting a photograph containing a child must have the legal authority and necessary permission to submit and use that image.

11 Changes and Contact

Terms and Conditions

These Terms and Conditions govern your access to NamedMemories.com and your purchase or use of Named Memories products and memberships. By using the website or placing an order, you agree to these Terms.

1 Eligibility and Acceptance

You must be at least 18 years old and legally able to enter into a contract to purchase from Named Memories. If you place an order for another person, you represent that you have authority to provide the submitted information and photograph.

2 The Named Memories Service

Named Memories transforms a customer-supplied photograph into a personalized graphite-style digital portrait and adds the customer-supplied name, title, or date. Digital delivery is ordinarily targeted within 24 hours after we receive the photograph, wording, payment, and any information needed to complete the order. The 24-hour period is an estimate, not a guarantee, and may be affected by order volume, image quality, revisions, technical issues, or customer response time.

The service is a creative transformation. Screen settings, printers, paper, cropping, and production processes may cause differences in appearance. We do not guarantee that every photograph is suitable or that the output will meet every subjective preference, but we will follow the approval and correction process in the Refund and Cancellation Policy.

3 Customer Content and Permissions

You retain your rights in the photograph and other content you submit. You grant Named Memories and its service providers a limited, nonexclusive license to access, copy, process, modify, and transmit that content solely as needed to create, revise, deliver, and support your order and fulfill legal obligations.

You represent that you own the submitted content or have permission from the owner and any identifiable person necessary to use it for the requested portrait. You may not submit content that is unlawful, infringing, deceptive, threatening, exploitative, or otherwise violates another person's rights. We may decline or cancel an order that we reasonably believe violates these Terms and will handle any refund according to the status of the work.

4 Portrait Rights and Permitted Use

After full payment, you may download, print, display, and share the delivered portrait for personal, noncommercial purposes. You may not resell the portrait, remove or misrepresent Named Memories branding, use it as a trademark, or use it in commercial merchandise or advertising without written permission. Named Memories retains ownership of its name, website, templates, layout, branding, processes, and other preexisting materials. To the extent legally permitted, no rights are granted beyond those expressly stated here.

5 Customer Approval

You are responsible for supplying accurate spelling, punctuation, names, titles, dates, and instructions. We will correct our transcription or production errors without charge when reported promptly. When a proof or approval request is provided, carefully review the image, wording, and layout before approving it. Approval authorizes final digital delivery and, when purchased, printing. Changes requested after approval may require an additional fee.

6 Prices Payment and Taxes

Current prices and included features are shown at checkout. Prices may change for future purchases or membership renewals after any notice required by law. You authorize our payment provider to charge the payment method selected at checkout, including recurring membership charges. Applicable taxes, shipping, or other disclosed charges may be added.

7 Membership Terms

The Named Memories Membership currently includes up to four personalized digital Named Memories during each monthly billing period for the price displayed at checkout. Unused portraits do not roll over to a later billing period. Printed copies may be purchased at the then-current member price. The membership renews automatically each month until canceled.

You may cancel at any time before the next renewal through any cancellation method made available with your purchase or by emailing [email protected]. Cancellation stops future renewal charges and does not retroactively refund the current billing period. You may use any remaining benefits through the end of the paid billing period unless the membership is terminated for misuse or otherwise required by law. Cancellation and refund details appear in the Refund and Cancellation Policy.

8 Acceptable Use

You may not interfere with the website, attempt unauthorized access, introduce malicious code, scrape or copy substantial portions of the website, impersonate another person, commit fraud, or use the service in violation of law or another person's rights.

9 Third Party Services

The website relies on third-party services, including Kajabi and payment, email, analytics, printing, and delivery providers. Those services may have separate terms and privacy practices. Named Memories is not responsible for a third party's independent acts, outages, or policies, except to the extent responsibility cannot legally be excluded.

10 Disclaimers and Limitation of Liability

To the fullest extent permitted by law, the website and services are provided on an as-available basis without warranties not expressly stated in these Terms. Named Memories does not warrant uninterrupted access or error-free operation. Nothing in these Terms excludes warranties, remedies, or liabilities that cannot legally be excluded.

To the fullest extent permitted by law, Named Memories will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the website or services. Named Memories' aggregate liability concerning a particular order will not exceed the amount paid for that order or, for a membership claim, the amount paid during the three months preceding the event giving rise to the claim. These limits do not apply where prohibited by law.

11 Indemnity

To the extent permitted by law, you agree to defend and indemnify Named Memories against third-party claims arising from content you submit, your lack of permission to use that content, your unlawful use of the service, or your material violation of these Terms.

12 Governing Law and Disputes

California law governs these Terms without regard to conflict-of-law principles. Before filing a formal claim, you and Named Memories agree to make a good-faith effort to resolve the dispute by contacting the other party. Any court proceeding shall be brought in a court of competent jurisdiction serving Solano County, California, unless consumer law requires another location.

13 Changes Severability and Contact

We may update these Terms for future use of the website and future purchases. Changes to an active membership will be handled with any notice required by law. If a provision is unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver.

Refund and Cancellation Policy

This policy explains approvals, corrections, refunds, damaged printed copies, and cancellation of the Named Memories monthly membership.

1 Personalized Digital Portraits

Named Memories portraits are personalized products created from the photograph, title, name, date, and instructions supplied by the customer. Because work is customized and may begin shortly after an order is placed, an order may be canceled for a full refund only if cancellation is received before portrait production begins.

When we provide a proof for approval, the customer must review the portrait and wording carefully. If the portrait contains our spelling, transcription, cropping, or production error, we will correct it without charge. A customer may request one reasonable revision before approval when the request remains within the original order and source photograph. Requests that change the photograph, concept, or original instructions may require a new order or additional charge.

Once the customer approves a proof or the final high-resolution portrait is delivered following that approval, the personalized digital purchase is final and nonrefundable, except where required by law. If we cannot correct a material error or deliver the purchased portrait, we will provide an appropriate replacement, account credit, or refund.

2 Customer Response and Abandoned Orders

If we need a usable photograph, corrected wording, approval, or other information, production will pause until the customer responds. Delivery estimates do not run during that pause. We may close an incomplete order after reasonable follow-up if the customer does not provide the information necessary to complete it. Any refund or credit will depend on the amount of customized work already completed and applicable law.

3 Printed Copies

Printed copies are produced from the customer-approved portrait. Approval of the digital proof also approves the image, spelling, title, date, and layout for printing. Approved customization choices are not grounds for a refund after printing begins.

If a printed copy arrives damaged, defective, or materially different from the approved portrait because of our or the printer's error, contact [email protected] within 7 days after delivery. Include the order information and clear photographs showing the issue. After verification, we will replace the affected print at no additional charge or provide another remedy required by law. Damage caused after delivery, an incorrect address supplied by the customer, ordinary color differences between screens and print, or customer-approved content generally does not qualify for a refund.

4 Membership Billing

The Named Memories Membership renews automatically each month at the price disclosed at checkout until canceled. Each billing period includes up to four personalized digital Named Memories. Unused portraits expire at the end of the billing period and do not roll over. Printed copies are separate purchases.

5 Canceling a Membership

You may cancel at any time before your next renewal using any cancellation method provided with your purchase or by emailing [email protected]. Your cancellation becomes effective for the next billing period. You will not be charged again after the cancellation takes effect, and you may use remaining benefits through the end of the already-paid billing period unless otherwise stated or required by law.

Canceling does not automatically refund a charge that was properly processed before the cancellation became effective. To avoid the next charge, submit the cancellation before the renewal date. We will provide confirmation of cancellation.

6 Membership Refunds

Membership charges are generally nonrefundable once a billing period begins, particularly when portrait work has started or membership benefits have been used. If a duplicate or incorrect charge occurs, or if law requires a refund, contact us promptly. If no portrait work has begun and no benefits have been used during the current billing period, we may approve a refund request at our discretion.

7 Charge Disputes

Please contact [email protected] before initiating a payment dispute so we have an opportunity to investigate and correct any billing or fulfillment problem. This request does not limit any right you may have under applicable law or your payment-card agreement.

8 How to Request Help

Send cancellation, correction, replacement, or refund requests to [email protected]. Include your name, the email used for the purchase, the order date, and a brief explanation. Do not resend sensitive payment-card information by email.
